Effective Date: January 1, 2026
IMPORTANT: By confirming your booking and making a payment to PT Kanha Citta Bahari (Kanha Liveaboard), you automatically, legally, and unconditionally agree to be bound by all the Terms and Conditions outlined below.
1. RESERVATIONS & PAYMENTS
- Booking Confirmation: Your reservation is confirmed only upon our receipt of a minimum 50% deposit of the total invoice amount, no later than 4 days after the invoice is issued.
- Balance Payment: The remaining balance must be settled according to the schedule stated on your invoice prior to departure. For Short Notice bookings (less than 60 days prior to departure), full payment (100%) is required upfront.
- Payment Methods: Payments made via Payment Link, Wise, or Revolut are subject to an additional 3% administrative fee.
- Failure to Pay: Failure to meet payment deadlines grants Kanha Liveaboard the absolute right to automatically cancel the reservation and offer the berths to other guests.
2. CANCELLATION POLICY (BY GUEST)
Should you need to cancel your trip for any reason, the following strict penalty scheme applies:
- > 90 days prior to departure: 10% charge of the total cost.
- 90 – 61 days prior to departure: 20% charge of the total cost.
- 60 – 31 days prior to departure: 50% charge of the total cost.
- ≤ 30 days prior to departure: 100% charge (No Refund).
3. GUEST SUBSTITUTION & NO-SHOW
- Substitution: If you are unable to attend, your reservation may be transferred to another individual up to 5 days prior to departure (subject to vessel conditions and management approval). The substitute guest will be bound by the exact same Terms & Conditions.
- No-Show & Late Arrivals: Our crew will wait a maximum of 2 hours at the designated meeting point. Failure to arrive on time, resulting in disruption to the sailing schedule, is considered a last-minute cancellation. No refunds will be issued.
4. FORCE MAJEURE
In the event of circumstances beyond our reasonable control (Force Majeure)—including but not limited to severe weather conditions endangering the voyage, natural disasters, epidemics/pandemics, riots, or government/port authority restrictions:
- Kanha Liveaboard reserves the right to unilaterally cancel, delay, or alter the itinerary for safety reasons.
- NO REFUNDS will be provided for cancellations resulting from Force Majeure situations.
- Your payment is NOT FORFEITED. Your reservation will be converted into a Reschedule Credit. You are entitled to select a new departure date within 12 months from the original trip date, without penalty fees (subject to availability).
- Kanha Liveaboard is not liable for any third-party financial losses incurred by the guest (e.g., non-refundable flight tickets, onshore hotel bookings).
5. CAPTAIN’S AUTHORITY & ITINERARY CHANGES
Safety is our ultimate priority. The Ship's Captain holds absolute authority during the voyage. Kanha Liveaboard reserves the right to spontaneously alter routes, schedules, or omit specific activities due to adverse weather, ocean currents, or technical issues to ensure passenger safety. No refunds will be issued for unused services, destinations, or routes resulting from these necessary adjustments.
6. INSURANCE & LIABILITY WAIVER
- Package prices do not include Travel Insurance. You are MANDATED to hold comprehensive personal travel and medical insurance (covering accidents, emergency marine medical evacuation, and trip cancellation).
- By participating, you certify that you are physically fit and fully understand the inherent risks associated with marine wilderness activities (snorkeling, diving, remote sailing).
- You agree to release and hold harmless PT Kanha Citta Bahari, its staff, crew, and partners from any and all legal claims arising from physical injury, loss of life, or damage/loss of personal property during the program.
7. VESSEL ASSET DAMAGE & LOSS
Guests bear full responsibility for any damage or loss to vessel facilities, water sports equipment, linens, towels, and other company assets caused by negligence, carelessness, or intentional acts. Guests must pay 100% of the current market replacement value for the damaged/lost items prior to disembarkation.
8. PRICE ADJUSTMENTS & CHILD POLICY
- Children above 3 years old are subject to the normal full rate.
- In exceptional circumstances, Kanha Liveaboard reserves the right to adjust package prices up to 21 days prior to departure in the event of drastic spikes in fuel costs, government taxes/levies, or severe currency exchange rate fluctuations.
